Element ATA Martial Arts ("we," "us," or "our") operates the website elementata.com and our facility at 1124 Arnold Drive, Suite 101B, Martinez, CA 94553. This Privacy Policy explains what information we collect when you visit our website or contact us, how we use it, and the choices you have.

Information You Provide to Us

Our Contact and Free Trial pages use an embedded form provided by SparkMembership, our student management platform, to collect your name, email address, phone number, and program of interest. Submitting that short form redirects you to a full student intake form hosted on SparkMembership's own site, which may ask for additional information (such as a mailing address or details about the student) needed to schedule a class or complete enrollment. Information you enter on SparkMembership's hosted pages is collected and processed by SparkMembership on our behalf and is also subject to SparkMembership's own privacy practices.

If you email or call us directly, we collect whatever information you choose to share, such as your name, contact details, and the content of your message.

We do not collect payment information through this website. There is no checkout, no shopping cart, and no credit card, debit card, or bank account field anywhere on elementata.com. Tuition and any other payments are handled in person at the school or through our student management platform's own secure systems, never through a form on this site.

Information We Collect Automatically

We use Umami Analytics, a privacy-focused analytics tool that we self-host on our own server, to understand how visitors use our site. Umami does not use cookies and does not store anything on your device. It does not track you across other websites, does not build an advertising profile, and is not shared with any advertising network. It reports only aggregate, anonymized data: page views, which page referred you, general device and browser type, and an approximate country or region derived from your IP address. Your IP address is not stored, and no personal data is collected through our analytics.

Alongside page views, we count a small number of anonymous interactions so we can tell which parts of the site are useful: clicks on our phone, email, and "free trial" links, and whether the enrollment form on our Contact and Free Trial pages was seen and submitted. These are recorded as counts only, with no identifier attached to them, so they cannot be traced back to you or to a single visit.

Our Contact page embeds a Google Maps location. Loading that map shares your IP address and device information with Google, subject to Google's own privacy policy.

The SparkMembership form embed on our site is a third-party script and may use its own cookies or similar technology to operate the form and process submissions, governed by SparkMembership's privacy policy rather than ours.

SMS / Text Message Communications

If you opt in via our web forms, you consent to receive periodic text messages from Element ATA Martial Arts about our programs, class scheduling, and, occasionally, promotional offers. Message and data rates may apply, and message frequency varies. Consent to receive text messages is not a condition of any purchase or enrollment.

• Reply HELP at any time for assistance with the messaging program.
• Reply STOP at any time to unsubscribe. We will confirm your opt-out by text, and you will not receive further messages from us unless you opt in again.
• Carriers are not liable for delayed or undelivered messages.

SMS opt-in consent and phone numbers collected for texting purposes are never shared with third parties or affiliates for their own marketing purposes.

How We Use Your Information

• To respond to inquiries and schedule free trial classes, tours, or other appointments
• To communicate with you about our programs, classes, and your (or your student's) enrollment
• To send marketing communications and promotional offers, where you have opted in, with the ability to opt out at any time
• To understand site usage, in aggregate and anonymized form, so we can improve our website
• To comply with legal obligations and protect against fraud or misuse of our services

How We Share Your Information

We do not sell your personal information. We share information only as follows:

• SparkMembership, which processes our contact and free trial form submissions and manages student enrollment and scheduling on our behalf
• Service providers who support our business operations (such as hosting and analytics), bound to use your information only to provide those services to us
• Law enforcement or other authorities, where required by law or necessary to protect our rights, students, or staff

Children's Privacy

Our programs serve students as young as 3 years old. Our website forms are intended to be completed by a parent or legal guardian on behalf of a prospective student, not directly by a child. We do not knowingly collect personal information directly from children through our website.

How Long We Keep Your Information

We keep personal information only as long as we have a reason to. In practice that means:

• Inquiries and trial requests that do not lead to enrollment: up to 24 months from your last contact with us, after which we delete or anonymize the record
• Enrolled student records: for the duration of enrollment, and then as long as we are required to keep business, accounting, and tax records under California and federal law
• Text message consent records: for as long as you remain opted in, and for a period after you opt out, because we are required to be able to demonstrate that consent was given and later withdrawn
• Website analytics: aggregate counts only. There is no individual visitor record to retain, because none is created in the first place

We do not sell your personal information to anyone, for any purpose, and we never have.

To request deletion of your information, email info@elementata.com or call (925) 957-9383 and tell us you want your information deleted. We will confirm your request, delete what we are not legally required to keep, and tell you if anything must be retained and why. You do not need to be a current or former student to make this request, and we will not charge you or treat you differently for making one.

Security

We use reasonable administrative and technical safeguards to protect the information we collect. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your Rights and Choices

• You may ask us for a copy of the personal information we hold about you
• You may ask us to correct or delete your personal information
• You may opt out of marketing emails at any time using the unsubscribe link in those emails
• You may opt out of text messages at any time by replying STOP, as described above

To exercise any of these choices, contact us using the information below. California residents have additional rights under California law regarding access to and deletion of personal information; we do not sell personal information, so there is nothing to opt out of in that respect.

Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated effective date. If we make material changes to how we use your personal information, we will take reasonable steps to notify you.
